Pro Era Performance Pty Ltd ABN 90 684 132 661 is committed to managing personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act) and in accordance with other applicable privacy laws, such as the Health Records and Information Privacy Act 2002 (NSW) (HRIP Act) and the Health Privacy Principles (HPPs).

APPs set minimum standards to which Pro Era Performance Pty Ltd must adhere regarding how it collects, secures, stores, uses, corrects, discloses and provides access to personal and sensitive information. The HPPs also set similar standards that apply specifically to health information.

This document sets out our policies for managing your personal information and is referred to as our Privacy Policy.

In this Privacy Policy, "we" and "us" refers to Pro Era Performance Pty Ltd and "you" refers to any individual about whom we collect personal information.

About Pro Era Performance

Pro Era Performance Pty Ltd is a unit of health professionals, performance staff and athletes committed to helping you thrive in your performance goals. We work together to better understand your human needs, developing solutions to maximise your performance and wellbeing.

We adapt to suit any performance needs – working with individuals, groups, coaches and more to offer a range of services, including personal and team performance coaching, coach integration, physiotherapy and performance rehabilitation.

What information does Pro Era Performance collect about you?

Clients and prospective clients

When you enquire about our services or when you become a client of Pro Era Performance Pty Ltd, a record is made which includes your personal information.

The type of personal information that we collect will vary depending on the circumstances of collection and the kind of service that you request from us, but will typically include:

·         your name, e-mail, postal address, mobile and home phone and other contact details;

·         your date of birth;

·         your emergency contacts;

·         funding details: health fund, Medicare, NDIS, Workcover, 3rd party insurers, other private payer and card payment / EFT details;

·         health and wellbeing records (including current and past injury history), and additional needs;

·         information about your employer (for Workcover matters)

·         your professional details, sporting history and performance details, objectives and goals;

·         your image, audio and video recordings, including CCTV footage;

·         ID documents, government identifiers, nationality, location and language; and

·         any additional personal information you provide to us, or authorise us to collect, as part of your interaction with Pro Era Performance Pty Ltd.

Where you engage us to provide a health service to you, we will collect sensitive information such as health information from you directly, or from third parties (like your medical professionals/treating practitioners) either with your consent, or in an emergency.

Prospective employees or applicants

We collect personal information when recruiting personnel, such as your name, contact details, qualifications and work history, and if relevant, the following:

·         safeguarding information (including working with children check, National Police Check);

·          health information;

·         Medicare provider number;

·         AHPRA number; and

·         SIRA provider number.

Generally, we will collect this information directly from you.

We may also collect personal information from third parties in ways which you would expect (for example, from recruitment agencies or referees you have nominated). Before offering you a position, we may collect additional details such as your tax file number and superannuation information and other information necessary to conduct background checks to determine your suitability for certain positions (for example, positions which involve working with children or where we require a National Police check).

Note: Under the Privacy Act and the HRIP Act, the APPs and HPPs do not apply to an employee’s record. Therefore, this policy does not apply to Pro Era Performance Pty Ltd’s treatment of an employee record, where it relates to a current or former employment relationship between us and an employee.

Other individuals

Pro Era Performance Pty Ltd may collect personal information about other individuals who are not clients of Pro Era Performance Pty Ltd. This includes prospective customers and members of the public who participate in events we are involved with; individual service providers and contractors to Pro Era Performance Pty Ltd; and other individuals who interact with Pro Era Performance Pty Ltd on a commercial basis. The kinds of personal information we collect will depend on the capacity in which you are dealing with Pro Era Performance Pty Ltd. Generally, it would include your name, contact details, and information regarding our interactions and transactions with you.

If you are participating in an event we are managing or delivering (or attend our premises for other reasons), we may take images or audio-visual recordings which identify you, including through CCTV footage.

Our primary purpose for collecting information from our clients is for our practitioners to facilitate outcomes for clients, and to work collaboratively with relevant treating practitioners involved in a client’s care as necessary

We may collect and update your personal information over the phone, by email, over the internet (including online surveys) or social media, or in person, including during consultations. We may also collect personal information about you from other sources, for example:

·         third-party suppliers and contractors who assist us to operate our business.

For clients

For example, if you have engaged us to deliver a service, we may disclose information about you to service providers and treating practitioners where this is relevant to our services. Our service providers and related entities will be similarly bound by the Australian Privacy Principles.

 we use client’s information to facilitate optimal outcomes, We also share this information with relevant practitioners involved in care as necessary. We normally use and disclose the information for the purposes of collecting it – unless an exception under the APPs applies.

For customers and participants

If you are a customer or participant in an event, we may disclose your personal information to our clients and venues where this is reasonably necessary for, and relevant to, the delivery of the event. We may use images or audio-visual recordings which identify you for promotional purposes where you would reasonably expect this to occur.

Disclosure to contractors and other service providers

Pro Era Performance Pty Ltd may disclose information to third parties we engage in order to provide our services, including contractors and service providers used for data processing, data analysis, customer satisfaction surveys, information technology services and support, website maintenance or development, printing, archiving, mail-outs, and market research.

Personal information may also be shared between related and affiliated companies of Pro Era Performance Pty Ltd, located in Australia.

Pro Era Performance Pty Ltd is a predominantly Australian based organisation and works with clients, service providers, sponsors and commercial interests who are normally in Australia. However, from time to time we may use data hosting providers that are based overseas (cloud computing) and it is likely that your personal information will be disclosed to overseas recipients.

Unless we have your consent, or an exception under the APPs applies, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to your personal information (or is subject to a similar privacy regime to the APPs).

How can you access or seek correction of your personal information?

You will not be charged for making a request to access your personal information but you may be charged for the reasonable time and expense incurred in compiling information in response to your request.
